This page sets out the terms of use for containerhome.co.za and explains how Container Home SA collects, uses and protects your personal information, in line with South Africa’s Protection of Personal Information Act (POPIA). By using this website, you accept the terms below.

1. Acceptance of these terms

By accessing or using containerhome.co.za (this “website”), you accept these Terms & Conditions in full. If you do not agree with any part of them, please do not use this website.

We may update these terms from time to time. The “Last updated” date at the top of this page shows when that last happened. Continuing to use the website after a change means you accept the updated terms.

2. Permitted use of this website

You may use this website to learn about Container Home SA’s products and services, browse our completed builds, and submit enquiries. You agree not to:

  • use the website for any unlawful purpose;
  • attempt to gain unauthorised access to our systems or data;
  • copy, scrape or reuse our content for a commercial purpose of your own; or
  • interfere with, or attempt to disrupt, the website’s normal operation.

3. Accuracy of information

We take care to keep the information on this website accurate and up to date. Prices, specifications, delivery timelines, renders and photographs are provided for general guidance and marketing purposes only, and may change without notice. See “Quotations, pricing and products” below for how binding pricing actually works.

4. Intellectual property

All content on this website, including text, photographs, renders, floor plans, videos, logos and the Container Home SA brand, is owned by or licensed to Container Home SA, and is protected by South African copyright and trademark law.

You may view and share pages of this website for your own personal, non-commercial use. You may not copy, reproduce, republish, or use our renders, photographs, floor plans, videos or brand assets for any commercial purpose without our prior written permission.

5. Quotations, pricing and products

Prices, price bands, specifications, renders and photographs shown on this website are indicative and for marketing purposes only. Nothing on this website is a binding offer to sell.

A price becomes fixed only once we have issued a formal, written quotation and you have formally accepted it in writing. The signed build or sale agreement between you and Container Home SA, not anything shown on this website, is the binding document governing your purchase.

6. Enquiries and the "Start Your Build" form

Submitting the “Start Your Build” form, the Feasibility Report form, or any other enquiry form on this website is not a purchase and creates no obligation on either side. By submitting a form, you consent to Container Home SA (and, where the form says so, our finance partners) contacting you about your enquiry using the details you provide. We do not sell or share your details with unrelated third parties. See “Disclosure of your information” below.

7. Limitation of liability and no warranties

This website and its content are provided “as is”. While we take reasonable care to keep it accurate, we make no warranties, express or implied, about the completeness, accuracy or reliability of this website or its content. To the fullest extent permitted by South African law, Container Home SA will not be liable for any direct, indirect or consequential loss arising from your use of, or inability to use, this website. Nothing in this clause limits any liability that cannot lawfully be excluded or limited, such as liability for fraud or gross negligence.

9. Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any dispute arising from your use of this website, or from these terms, is subject to the exclusive jurisdiction of the South African courts.

10. Information we collect

We may collect:

  • your name and contact details (phone number, email address, and physical or delivery address);
  • information you provide when you use this website, submit an enquiry, or send us a message or email; and
  • technical information about how you use this website, such as the pages you visit.

If you phone us, your call may be recorded for service quality and staff training purposes.

11. How we use your information

We only process your personal information for a lawful purpose directly related to our business, and only to the extent reasonably necessary for that purpose. We use your information to:

  • provide and manage our services to you;
  • respond to your enquiries and follow up on quotes;
  • improve our website, products and service; and
  • where you have given consent, contact you with marketing or promotional information.

We do not share your personal information with unrelated third parties. We may disclose your information:

  • to our own staff and contractors who need it to do their job (for example, our finance partner, only where you have consented to this on the relevant form);
  • to a successor entity, if Container Home SA is ever merged with, or sold to, another business; or
  • where required by law, regulation, or a valid court order.

We do not sell your personal information to anyone.

This website uses cookies for:

  • keeping you logged in, where relevant;
  • monitoring website traffic and usage; and
  • personalising your experience of the website.

We retain your information only for as long as reasonably necessary to fulfil the purpose it was collected for, or for as long as the law requires (for example, financial and tax record-keeping requirements).

15. Your rights under POPIA

Under the Protection of Personal Information Act, 2013 (“POPIA”), you have the right to:

  • access the personal information we hold about you;
  • request that we correct or update inaccurate or outdated information;
  • request that we delete personal information we no longer have a lawful basis to hold; and
  • object to us processing your personal information, including for direct marketing.

16. Marketing communications and opt-out

We will only send you marketing or promotional communications if you have given your consent, for example by ticking a consent box on one of our forms. You may withdraw that consent and opt out at any time by emailing Admin@containerhome.co.za with the subject “Opt out”, or by using the unsubscribe link in any marketing email.

17. Changes to this policy

We may update this Terms & Conditions and Privacy Policy from time to time, for example to reflect a change in the law or in our business. The “Last updated” date at the top of this page shows when it was last revised. We encourage you to check back periodically. Continuing to use the website after a change means you accept the update.
